Terms of Use

1. Acceptance of Terms

By downloading or using Unspoken, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

By using Unspoken, you confirm that:

• You are at least 17 years old
• You are not in a country subject to a U.S. government embargo or designated as a "terrorist-supporting" country
• You are not on any U.S. government list of prohibited or restricted parties

2. Description of Service

Unspoken is an end-to-end encrypted, anonymous one-on-one chat application. No account or registration is required. Each session uses a randomly generated anonymous identifier.

The app is available as a one-time purchase on the Apple App Store. The underlying source code is open source under the MIT License, available at github.com/bones7456/Unspoken. Users with the technical ability may build and self-host the app at no cost.

3. Purchase and Payment

Unspoken is available as a one-time purchase via the Apple App Store. There are no subscriptions or recurring charges. All purchases are processed by Apple and subject to Apple's terms and conditions.

We do not offer refunds directly — please refer to Apple's refund policy for App Store purchases.

4. Acceptable Use

You agree not to use Unspoken to send, transmit, or store any content that is:

• Illegal under applicable law
• Threatening, abusive, harassing, or defamatory
• Obscene, sexually explicit, or otherwise objectionable
• Infringing on third-party intellectual property or privacy rights

We reserve the right to block users who violate these terms.

5. Content Moderation

While messages are end-to-end encrypted and inaccessible to us, users can report abusive peers via the in-app report function. Reported users may be blocked from the service. We aim to review reports within 24 hours.

6. Open Source License

The source code for Unspoken (both the iOS client and the server) is released under the MIT License. You are free to view, fork, modify, and redistribute the code, including for commercial purposes, provided you retain the original copyright notice.

The MIT License applies to the source code. The Unspoken name and branding remain the property of the developer.

7. App Store Distribution

The compiled iOS app distributed via the Apple App Store is subject to Apple's standard App Store terms. The following terms apply with respect to Apple Inc. ("Apple"):

• These Terms of Use are concluded between you and the developer, Li Luyang, and not with Apple. Apple is not responsible for Unspoken or its content.
• Apple has no obligation whatsoever to provide any maintenance or support services with respect to Unspoken.
• In the event of any failure of Unspoken to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Unspoken.
• Apple is not responsible for addressing any claims by you or any third party relating to Unspoken or your possession or use of Unspoken, including but not limited to: product liability claims; any claim that the app fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that Unspoken or your possession and use of Unspoken infringes a third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms of Use. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary thereof.

8. Disclaimer of Warranties

Unspoken is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. Use the app at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use Unspoken, including but not limited to loss of data, loss of communications, or unauthorized access to your transmissions.

Our total liability to you, for any cause, shall not exceed the amount you paid for the app.

10. Indemnification

You agree to indemnify and hold harmless the developer, Li Luyang, from any claims, damages, or expenses arising from your use of Unspoken or your violation of these terms.

11. Service Changes and Interruption

We reserve the right to modify, suspend, or discontinue the hosted service at any time. The open-source nature of the project means you can always self-host if the hosted service is unavailable.

12. Changes to These Terms

We may update these Terms of Use from time to time. Changes will be posted on this page with an updated date. Continued use of the app constitutes acceptance of the revised terms.

13. Governing Law

These terms are governed by applicable law without regard to conflict of law principles. Any disputes will be resolved in the jurisdiction where the developer is based.
